The investigation into the “Rotterdam+” case has been completed

SAP prosecutors clarified the wording of the suspicions announced to those involved in the case.

The updated composition of the group of prosecutors of the SAPS based on the results of the joint work of the updated group of prosecutors and NABU detectives, after a detailed analysis of the evidence collected in the case, made a number of important procedural decisions, reports the Specialized Anti-Corruption Prosecutor's Office.

In particular, six persons involved in the introduction of the so-called “Rotterdam+” formula were charged with causing 18.87 billion hryvnias in losses to electricity consumers during 2016-2017.

The change in suspicion was reported :

  • to the former head of the National Commission for Regulation in the Field of Energy and Communal Services (NCRECU);
  • the director of SE “Market Operator”, who at the time of the introduction of “Rotterdam+” was a member of the NCRECU;
  • to the head department of NCRECU;
  • head of management of NCRECU;
  • deputy commercial director of one of the private companies of the group – a key operator of the heat generation market of Ukraine;
  • director of the department of one of the companies of this group .

  • The actions of all persons are classified according to the characteristics of the crime provided for in Part 2 of Art. 364 of the Criminal Code of Ukraine. Representatives of private companies are charged with providing assistance.

On September 22, 2022, the SAP and NABU, having recognized the evidence collected during the pre-trial investigation as sufficient for drawing up an indictment, informed the defense of the completion of the pre-trial investigation and providing access to the materials criminal proceedings.

At the same time, SAP prosecutors, together with NABU detectives, are continuing the investigation of a possible assignment of damages under the so-called “Rotterdam+” formula during 2017-2018.

The Chief Anti-Corruption Prosecutor of Ukraine Oleksandr Klymenko canceled the resolution >on the closure of the so-called “Rotterdam+” case, which was adopted in May 2021, as illegal and unfounded.

As reported in the SAP, Klymenko also completely changed the group of prosecutors in in this case due to the ineffective supervision of compliance with laws during the pre-trial investigation.

“Rotterdam+” is a formula for calculating the cost of electricity produced by thermal power plants. The price of electricity includes the cost of coal in the port of Rotterdam in the Netherlands, plus the cost of transporting it to Ukraine, twice as well. Despite the fact that the lion's share of coal (more than 90%) was bought not in the Netherlands, but in Ukraine or in the occupied territories, which allowed thermal power plants to receive excess profits.
