The head of the Council of Europe proposed options for the creation of a special tribunal on Russian war crimes

The Council of Europe should play a leading role in creating a register for recording and documenting evidence and statements about damages, losses and injuries caused as a result of Russian armed aggression against Ukraine, convinced the Secretary General of the Council of Europe Maria Pejchynovych-Burych. This is stated in the document “Responsibility for human rights violations as a result of the aggression of the Russian Federation against Ukraine: the role of the international community, including the Council of Europe”. of Russia Pejchynovych-Burych emphasized that the Council of Europe has a good capacity to develop a register of such statements. In particular, this can be done in the context of the practice of the European Court of Human Rights and the process of monitoring its decisions.

“The organization already provides legal and political advice, trains investigative experts and specialists who work with victims of violence, especially women. These and other measures are included in the Action Plan of the Council of Europe for Ukraine for 2023-2026,” the Council of Europe website noted.

In addition, in the document, Maria Pejchynovych-Burych also proposed various options for creating a special tribunal and outlined the need for a reliable legal basis.

“Various options for creating a special tribunal have been proposed – all of them are ultimately based on treaties. Among the proposals is a special tribunal that can be established under a multilateral agreement between Ukraine and other interested states based on the precedents of the Nuremberg International Military Tribunal, the International Military Tribunal for the Far East or the International Criminal Court,” the document says.

Another option, according to Peychynovych-Burych, could be the creation of a special tribunal under an agreement between Ukraine and an international organization, in particular the UN. Also among the options is a “hybrid tribunal” based on Ukrainian legislation and approved/supported by the UN General Assembly.

The head of the Council of Europe is also convinced that the creation of a special tribunal will depend on the political will of the member states.

< p>Previously, the US State Department predicted that the International Tribunal or another mechanism, within the framework of which the Russian Federation can be held accountable for crimes against humanity and war crimes in Ukraine, may be ready already by the summer of 2023.

In addition, the European Union plans to create an international center that will deal with the prosecution of the crime of Russian aggression against Ukraine in The Hague.
